RPE Digital Tutor Terms & Conditions

These Terms & Conditions govern the purchase and installation of the RPE Digital Tutor provided by RPE Systems LLC.

1. Purchase Price
The total purchase price for the RPE Digital Tutor is $149 one-time.

Customers using the installation appointment process will pay:

$49 reservation payment when scheduling the Digital Tutor Installation Appointment.

$100 remaining balance before the installation begins.

The $49 reservation payment is applied toward the total $149 purchase price.

2. Installation Appointment
The Digital Tutor is installed and configured during a scheduled remote installation appointment, generally conducted by Zoom or another approved online meeting platform.

Customers are responsible for having the required account access, login information, course materials, textbook files, and other requested information available before the appointment.

Failure to provide necessary access or materials may require the appointment to be rescheduled.

3. Remaining Balance
The remaining $100 balance must be paid before installation begins.

RPE Systems reserves the right to delay or reschedule an installation if the remaining balance has not been paid.

4. Rescheduling
Customers may reschedule their installation appointment up to 12 hours before the scheduled appointment time, subject to appointment availability.

RPE Systems may permit additional rescheduling at its discretion.

5. Cancellations
Customers should cancel at least 24 hours before the scheduled installation appointment.

For cancellations received at least 24 hours in advance, the $49 reservation payment may be refunded or transferred to a rescheduled appointment at the discretion of RPE Systems.

Cancellations made less than 24 hours before the appointment may result in forfeiture of the $49 reservation payment.

6. No-Shows
Customers who fail to attend their scheduled installation appointment without providing advance notice may forfeit the $49 reservation payment.

A new $49 reservation payment may be required to schedule another installation appointment.

7. RPE Systems Cancellations
If RPE Systems must cancel an appointment and a reasonable replacement appointment cannot be provided, the customer may receive a refund of amounts paid for the uncompleted Digital Tutor installation.

Customers will not forfeit their reservation payment when the cancellation is caused by RPE Systems.

8. Digital Product and Installation Service
The Digital Tutor includes the configuration and installation of a personalized digital tutoring environment.

The customer is purchasing access to the configured Digital Tutor and installation service. The purchase does not transfer ownership of RPE Systems' proprietary templates, internal prompts, installation procedures, workflows, training materials, or other intellectual property used to create or configure the Digital Tutor.

Customers may not copy, reproduce, resell, distribute, sublicense, or commercially reproduce RPE Systems' proprietary installation materials or processes.

9. Customer Content
Customers remain responsible for the materials they provide for use with the Digital Tutor, including textbooks, notes, study guides, course documents, and other content.

Customers represent that they have the right to use or upload the materials they provide.

RPE Systems does not grant customers any additional rights to copyrighted course materials or third-party content.

10. Technology and Availability
The Digital Tutor may rely on third-party platforms, internet services, digital tools, and other technology providers.

RPE Systems does not guarantee uninterrupted or error-free availability of third-party services and is not responsible for outages, changes, restrictions, or service interruptions caused by third-party providers.

11. Educational Disclaimer
The Digital Tutor is intended to assist with studying, learning, review, explanation, and academic preparation.

RPE Systems does not guarantee grades, test scores, academic performance, course completion, admissions decisions, certifications, or other educational outcomes.

Customers remain responsible for their own academic work and compliance with school, college, university, instructor, and examination policies.

12. Refunds After Installation
Because the Digital Tutor is a customized digital product and installation service, payments are generally non-refundable once installation has been completed.

RPE Systems may issue refunds, credits, corrections, or other remedies at its discretion when a technical or service issue prevents delivery of the purchased service.

13. Limitation of Liability
To the maximum extent permitted by law, RPE Systems LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use or inability to use the Digital Tutor.

Where permitted by law, RPE Systems' total liability related to a Digital Tutor purchase will not exceed the amount actually paid by the customer for that purchase.

14. Acceptance of Terms
By scheduling an installation appointment, submitting payment, or using the RPE Digital Tutor, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Nature of the Digital Tutor Service

The RPE Digital Tutor is a guided setup, configuration, and training service designed to help the customer create and use a personalized Digital Tutor using an established third-party digital platform.

RPE Systems LLC does not sell, license, own, or operate the underlying third-party software platform used to create the Digital Tutor.

The customer is purchasing RPE Systems’ time, guidance, configuration assistance, installation support, and training related to setting up and using the Digital Tutor.

The purchase may include assistance with:

* configuring the Digital Tutor,

* adding textbooks, course materials, notes, and study resources,

* setting up voice and personalization features,

* learning how to interact with and use the Digital Tutor,

* and understanding how to manage the Digital Tutor after setup.

The customer is not purchasing:

* a human tutor supplied by RPE Systems,

* a proprietary software platform owned by RPE Systems,

* a recurring tutoring subscription,

* an ongoing managed tutoring service,

* or continuous management of the Digital Tutor by RPE Systems.

Any separate account, subscription, usage limits, terms, policies, features, pricing, or availability associated with the underlying third-party platform are governed by that platform and are separate from the fee paid to RPE Systems.

RPE Systems does not control and is not responsible for changes made by the third-party platform, including changes to features, access, pricing, availability, limits, or terms of service.

Customer Responsibility

The customer is responsible for creating, maintaining, and complying with the terms of any third-party account required to operate the Digital Tutor.

The customer is also responsible for providing lawful access to any textbooks, course materials, notes, or other content used during setup.

No Ongoing Management

Unless separately agreed to in writing, RPE Systems’ responsibility is limited to the purchased setup, configuration, installation, and training service.

After the setup is completed, the customer is responsible for operating and managing their Digital Tutor.
